Terms of Use

1. The agreement

These terms are an agreement between you and the developer of Nomi named on its App Store page (“Nomi”, “we”, “us”) for the Nomi iPhone app, on the App Store as “Nomi Crew: AI Calorie Tracker”. By using the app, you accept these terms and our Privacy Policy. If you don’t accept them, please don’t use Nomi.

2. Who can use Nomi

• You must be 13 or older.
• If you are under 18, or under the age of majority where you live, you need a parent or guardian’s permission, and they accept these terms for you.
• People aged 13 to 17 get a maintenance plan only, with no weight-loss goal, and fasting is not offered to anyone under 18.

3. Health notice

• Talk to a doctor before changing how you eat or train, especially if you are pregnant or breastfeeding, have diabetes or take medicine for blood sugar, or have any other medical condition.
• Nomi is not meant for people with an eating disorder, now or in the past. If food, weight or exercise feel hard to control, please reach out to a doctor or a local support service.
• Nomi never sets a daily target below 1,200 kcal (female) or 1,500 kcal (male), and won’t plan to lose more than 1% of your body weight a week. These are general limits, not personal advice.
• In an emergency, call your local emergency number.

4. AI answers

The bots are AI, not people. They can misread a meal, a photo or a label, get a number wrong, or say something that doesn’t fit you. Check what they log before you rely on it, and edit anything that’s off. Don’t follow a bot’s suggestion if it seems unsafe for you.

To answer you, Nomi sends your requests to outside AI providers, as the Privacy Policy explains. You can turn AI off in Settings → Privacy choices, but most features need it.

To keep the service fair and affordable, each account has a daily allowance of AI requests. When you reach it, you can still log by hand until it refills.

5. Crew Pass

Some or all of Nomi’s features need Crew Pass, an auto-renewing subscription sold through the App Store.

• Plans and prices. Crew Pass comes as a monthly or a yearly plan. The app shows the price in your local currency, with any taxes as the App Store shows them, before you buy.
• Free trial. The yearly plan may include a 7-day free trial if you are eligible. Unless you cancel at least 24 hours before the trial ends, your Apple account is charged the yearly price when it ends.
• Payment. Apple charges your Apple account when you confirm the purchase, or when a free trial ends.
• Auto-renewal. Crew Pass renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. Apple charges the renewal within the 24 hours before the period ends.
• Cancelling. Cancel any time in iOS Settings: tap your name, then Subscriptions, then Nomi. You keep Crew Pass until the end of the period you paid for. Deleting the app or your Nomi account does not cancel it.
• Refunds. Apple handles refunds under its own rules. You can ask Apple for one at reportaproblem.apple.com.
• Price changes. If the price changes, Apple tells you first and, where required, asks you to agree before the next renewal.
• Restore. If you reinstall the app or move to a new iPhone, use Settings → Crew Pass → Restore purchases.

6. Your content

Your meals, messages, photos, recipes, workouts and other things you add to Nomi stay yours. You give us permission to store, copy, process and send them to the services in our Privacy Policy, only to run Nomi for you. This permission ends when you delete the content or your account, except for copies those services keep under their own policies.

Only add content you have the right to use. Don’t upload photos of other people or their private information without their permission.

7. Acceptable use

Please don’t:

• break the law, or use Nomi to harm yourself or anyone else;
• try to get around the daily AI allowance, the subscription, or the app’s safety limits, for example by making many accounts;
• use Nomi to send spam, malware, or content that is illegal, hateful or sexually explicit;
• copy, resell or reverse-engineer the app or its AI service, or access our server other than through the app;
• scrape, overload or attack our systems, or try to see other people’s data.

8. Our app

We give you a personal, non-exclusive, non-transferable right to use the Nomi app on Apple devices you own or control, under these terms and Apple’s rules. Nomi, its name, the bots and their mascots, and the app’s design and code belong to us. If you send us feedback, we may use it without owing you anything.

We may change, add or remove features. Some features depend on outside services, such as AI providers, and may be slow or unavailable at times.

9. Apple and other services

Apple’s Licensed Application End User License Agreement (the Standard EULA) also applies to your use of the app. If it conflicts with these terms about the licence to use the app, the Standard EULA wins. Apple is not responsible for Nomi or for support; we are.

Apple Health, the App Store and the AI providers are run by others under their own terms. We aren’t responsible for their services.

10. Ending your use

• You can stop using Nomi any time, and delete your account in Settings → Delete account. Cancel Crew Pass separately (section 5).
• We may suspend or close an account that breaks these terms or puts others or our service at risk. Where we reasonably can, we’ll tell you why first.
• If we ever shut Nomi down, we’ll give you notice in the app and time to export your data where possible.

Sections 6 (the part about copies kept by others), 8, 11, 12 and 13 continue after your use ends.

11. Disclaimers

Nomi is provided “as is” and “as available”. As far as the law allows, we make no promises that Nomi will be accurate, uninterrupted, error-free or suited to your goals, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some places don’t allow these disclaimers, so they may not all apply to you.

12. Limits on liability

As far as the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data or profits, arising from your use of Nomi, including decisions you make based on its estimates. Our total liability for any claim about Nomi is limited to the greater of what you paid for Crew Pass in the 12 months before the claim, or US$50.

Nothing in these terms limits rights you have as a consumer that the law says can’t be limited, or liability for death or personal injury caused by negligence, or for fraud.

13. Governing law

These terms are governed by the laws of the Republic of the Philippines, unless the law where you live gives you the right to bring a claim in your local courts. Before going to court, please email us so we can try to sort it out together.

14. Changes and contact

We may update these terms. If a change matters, we’ll tell you in the app before it takes effect. If you keep using Nomi after that, you accept the new terms.

If part of these terms can’t be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement between you and us about Nomi.
